Recent Changes to the Australian Immigration Rules

Skilled Migrant Visas

The Australian Government has raised the pass mark from 60 to 65 points. This may not seem like a big difference, however, it affects thousands of people's cases and whereas they would previously be eligible for permanent residency on arrival, they will now need to secure state nomination under the 190 Visa class or the 489 Visa option to reach the 65 points pass mark.

To secure a state nomination a person must agree to live and work in that state for 2-years after arrival.

State nominations are only offered if the state has a shortage of skills in a specific profession and stop issuing invitations once they meet their skills quotas.

The reason for the change from 60 to 65 points is to ensure new skilled migrants are encouraged as much as possible to emigrate to where their skills are in the highest demand as opposed to being eligible to move anywhere in Australia on arrival.

457 Employer Sponsorship Visas

This was a popular visa, which allowed 95,000 people a year to emigrate to Australia. By removing this visa class Australia are making a clear statement that they want to control immigration at the state and federal government level.

Their aim is to only select only the highest quality skilled workers to emigrate to Australia. Previously, it was felt employers were looking for the cheap labour as opposed the most highly skilled migrants.

The Changes means a candidate must first pass the Australian immigration skilled migration assessment tests to be selected by either the federal or state government to emigrate.

TSS Visas

There is a replacement to the 457 employer sponsorship visa called the TSS Visa which continues to allow people to be sponsored by employers, but in most cases, these visas are only available on a two-year rolling basis, for the duration of the employment. They do not lead to residency and the person would need to leave Australia at the end of their employment. Obviously, this is not an attractive nor secure proposition for most people who wish to emigrate to Australia and especially those with children.

There are still visa options that would allow you to secure permanent residency on arrival, but that may change in the coming year.

If you want to emigrate to Australia and are eligible today we recommend you take the opportunity before further planned tightening of the rules come into effect.

The age limit as reduced from 50 to 45 for skilled migrant visas

Those over 45 years old are no longer eligible for a skilled worker visas. Other visas may be available to meet their emigration requirements.

Retirement Visas

The 405 retirement visa has now been abolished, They were unpopular for the time they were available as they did not lead to residency and required a large, permanent investment. Thankfully, there are other investment visas that remain available and suitable for those willing and able to invest in Australia for a four-year period. Residency can be provided on arrival which is a much more secure way to emigrate as a retiree.
